The purpose of this site is to help explore ways to facilitate safe and sensuous encounters. The perspective is taken that we all benefit by helping ladies structure encounters in which they feel and actually are safe.
The word "safe" has two relevant meanings for safe sensuous encounters. One is safety from physical harm and intimidation. The other meaning deals with safety from harassment by legal agents of society. A safe sensuous encounter should be structured in a way that it is legal. Throughout the remainder of this post, for simplicity of terminology, the notion of safety will mean both safety from physical harm and safety from harassment by vice cops. The concept of physical harm is straight forward. Safety from harassment by vice cops does not mean the sensuous encounter is illegal. Instead, the effort will be made to develop a way to structure the sensuous encounter legally and also minimize the likelihood of harassment from vice cops.
This legality issue needs some further development. It seems the area of prostitution can be murky and hard to detect. Yet vice cops are hired to do something. They are not going to further their careers and satisfy the community, by conceeding to the will of consenting adults to have sex. So, even though it may be difficult to nail someone for prostitution, cunningly directed harassment can and probably does put a general damper on prostitution; unfortunately, illegal harassment probably also reduces our society's enjoyment of perfectly legal sensuous encounters. The intent of this site is to respect the law and to adhere to the law. However, it is also the intent of this site to clarify the limits of the law so as not to be unnecessarily harassed and intimidated into missing enjoyment and pleasure of legal and safe sensuous encounters.
It's interesting to think of legal clarity as extending across a continuum. The continuum extends from clear illegality, through murkiness to clear legality.
---Illegality ----------- Murkiness ------------ Legality ----
Texas' legal definition of prostitution centers around engaging in sexual conduct for a fee. The fee part is particularly relevant. Toward the left, illegal end of the above continuum, prostitution clearly occurs when a lady verbally barters with a man about how much she charges for oral or genital sex. Such behavior is clearly illegal and does not constitute a safe, sensuous encounter.
Toward the right, legal end of the above continuum, an example of a couple living together might constitue a situation for safe, sensuous encounters. Clear legality would require the partners in the sensuous encounter to be on equal financial terms. If there is a large difference in wealth between the two individuals, then there is a very real likelihood of slipping toward the murky center of bartering sexual favors for financial benefits - engaging in sexual conduct for a fee.
An interesting example of murky legality involves marriage between two individuals who differ considerably in wealth. Such a marriage falls right in the murky middle of the above continuum. When such a couple marries, their new status in many states results in equal division of their community property. The poorer individual benefits financially and could be perceived as receiving a fee. But a fee for what? Well, from many religious perspectives, the marriage is not fully recognized until it is consumated with sexual intercourse. From a legal perspective, there is transfer of property or payment of a fee for what might religiously be viewed as a requirement to have sexual intercourse. Clearly, not all marriages are so structured as to involve prostitution by definition. However, for those marriages in which there is financial disparity, the situation is prostitutionally murky indeed. And yet, there is little or nothing reported in newspapers of married couples being arrested or harrased for engaging in prostitution - engaging in sexual conduct for a fee.
The murky middle of this continuum is a source of numerous ideas. What if a couple could get married for an hour or two, partition their finances and consumate the marriage with sexual intercourse? Would this constitute prostitution? This seems like considerable unnecessary trouble. However, the dynamics of the murky middle suggest several approaches that might be applied toward establishing legally safe, sensuous encounters.
One purpose of this site is to enable us to pool our collective experiences and knowledge to develop steps that could be taken in structuring safe sensuous encounters. To provide some initial structure to this exploration, a typical encounter will be presented in parts. Then for each part, steps will be presented that could make that particular part safe and sensuous. Readers are encouraged to write in with their ideas and experiences about how to make any or all parts of encounters more safe. Ideas and suggestions will then be included for safe sensuous encounters.
Presently, one of the better places to advertise appears to be in local newspapers with an adult section. The Live Entertainment section of "The Austin Chronicle" is a good example. The Austin Chronicle also has an Adult Services section where some individuals advertise. It's probably not a good idea to place an ad for a sensuous encounter in the "massage" section of "The Austin Chronicle." Email on the net indicates Austin vice cops have harassed customers of ladies offering sensuous massages. The ladies also suffered harassment. These ladies' ads can usually be spotted by their relatively high prices. The harassment may partially be motivated by complaints from registered massage therapists. It's probably not a good idea to be irritating any organized profession, such as massage therapists. Members of such professions might complain to the police who are then obligated to investigate.
There are also several sites for advertising on the Internet. These sites generate an enormous number of calls and email. This approach to advertising requires a thorough understanding of how to structure sensuous encounters that are safe physically and safe from harassment by legal authorities. The Clarity site also will post an ad for interested ladies.
Advertising can also play an important role in beginning to establish the legality of a sensuous encounter. This will be discussed more thoroughly below. However, the advertising statements are a good opportunity for being very clear about what a fee is for and what the fee is not for.
One deserving lady had a website that included a disclaimer about the fee. She sought legal counsel and was advised to include the disclaimer, and its particular wording, on her website. Here is an excerpt from her disclaimer:
"Please note: this is not an offer for prostitution. Money exchanged is for time and companionship only. No fees or tips of any kind will be quoted, negotiated, assessed, or collected in exchange for any sexual conduct. Time together may include services such as erotic dancing or modeling. Anything else that may occur is a matter of personal choice between two or more consenting adults of legal age, and is not
contracted for, nor is it requested to be contracted for, or compensated for in any manner."
Her disclaimer clearly states her fee is not for prostitution. Were she to get illegally arrested by vice, her lawyer could present the disclaimer from her website as evidence that the fee she receives is not for sexual conduct or prostitution. Then it would not just be her word against the vice cop's word. Her disclaimer would make it very clear to a judge or jury, that it is her intent that the fee is not for prostitution or sexual conduct. This is an important point to establish in one's advertising.
Another site that exhibits a lady has done her legal homework is
Piper's.
In Morris v. State (1978), the only evidence presented was the verbal testimony of the police officer and the lady. After hearing the confilicting testimony, the jury chose to believe the police officer and the lady was convicted. Other than verbal testimony, there was no other evidence presented.
I think deserving ladies would benefit by being able to bring more concrete evidence with them to court should they be arrested. Examples of advertising can be concrete evidence that a lady intends for the fee to be in no way associated with sexual conduct.
Here are some comments about "Advertising" that have been received. Does any one know of other good places to advertise for safe sensuous encounters?

Well, the hard part is over. At this point, the only guideline is to be considerate of your partner. As with any interaction with another human, there is a rhythm to developing trust. Exploring and investigating that rhythm with each other is part of the pleasure of a sensuous encounter.

The mutual value of return visits encourages each person to insure that it was a rewarding experience for both.
The reduction of exploitation and encouragement of mutual lasting enjoyment is a major focus of this site. My email address is listed below and at many other places throughout this site. I'd like to hear from the men and ladies about any way we can use this site to help make their experiences more rewarding and enjoyable. It may be that some of the ladies don't have computer access to the Internet. Feel free to copy, print and distribute the contents of this file. This information may also provide ideas to the ladies for making their efforts safer for us all. Comments and suggestions from everyone will be most helpful in building what is hoped will become a legal way to enjoy a safe sensuous encounter.
Most of the ladies who advertise in The Austin Chronicle, similar newspapers or on the Internet are involved in this process full time. Their phones are ringing all day and the ladies are constantly on the go. But what about the lady who only wants an occasional sensuous encounter. Is there a way for her to discretely arrange for an occasional sensuous encounter? I think there may be.
The biggest challenge is how to handle the enormous number of phone calls that are usually generated by an ad in The Austin Chronicle or similar newspaper. The solution involves having a computer that is connected to the Internet. It could be a computer at work, at home or at school. In fact it can be a computer anywhere as long as it is connected to the Internet for sending and receiving email.
The first step is to set up an alternative email box on the Internet for sending and receiving email. Be aware that many browsers maintain a history of sites visited on the Internet. If your significant other uses the same computer this alternative email box may not be totally secure. Two sites that provide email boxes for free are http://www.hotmail.com/ and http://www.WhoWhere.com/. This way you can check your email from home, school or work without creating a stir. These services also allow you to send email, so the communication issue with others on the Internet should be fairly easy to solve.
The next step would be to place an ad in a local adult newspaper like The Austin Chronicle, with the Clarity site or any of the multi-regional sites. However, instead of giving your telephone number, provide your email address at one of the above two services. There are a number of issues to consider in choosing between incall or outcall. However, you may have to schedule the session at your client's residence or arrange for a motel room depending on your circumstances. You are then in a position to communicate with prospective partners through email. You might even want to arrange to have coffee or lunch with someone before actually setting up a sensuous encounter. I think most men would find this quite reasonable and pleasant.
Other than adjusting for communicating over the Internet, the other information on this site about sensuous encounters also applies to the occasional, discrete sensuous encounter. As always, I'd be interested in hearing thoughts and suggestions about an approach like this.
Here is a summary of the basic twelve steps of what might be considered a safe legal Sensuous Encounter.

The Clarity site does not encourage nor condone illegal sexual conduct. Offering, agreeing, or engaging in sexual conduct for a fee is prostitution which is illegal in Texas. Illegal prostitution should be avoided. As consenting adults, it is hoped that we can safely enjoy the free sharing of sexual favors, if that is our desire.
